Terms and Conditions for Oakley Acres Farms, Shearing.
1. Introduction
By booking or using the services of Oakley Acres Farms, you agree to the following Terms and Conditions. These terms govern the relationship between Oakley Acres Farms ("we," "us," or "our") and the client ("you" or "your") who engages in shearing, wool handling, and related services.
2. Services Provided
Oakley Acres Farms provides professional shearing services for livestock, including sheep, alpacas, llamas, and other animals. The specific services provided will be outlined in the individual service agreement.
3. Booking and Confirmation

Booking: To book shearing services, clients must contact us via phone or email and provide the necessary information about the number of animals and location.

Confirmation: Once your booking is confirmed, you will receive a confirmation email with the appointment details. Please verify the information and notify us of any changes or corrections immediately.

Cancellations and Rescheduling: If you wish to cancel or reschedule your appointment, please notify us at least 48 hours in advance. Cancellations made less than 48 hours prior to the scheduled appointment may incur a cancellation fee of $25 (unless due to weather).
4. Pricing and Payment Terms

Pricing: The cost for shearing services is based on per animal with a travel/setup fee. A detailed pricing list will be provided upon booking.

Payment: Payment is due upon completion of the shearing service unless otherwise agreed. We accept payments via cash or paypal.

Late Payment Fees: A late fee of 50% will be applied to invoices not paid within 7 days of the service completion.
5. Client Responsibilities

Preparation: You are responsible for ensuring that your animals are ready for shearing. This includes ensuring the animals are clean and free from any severe injuries or health issues. The animals need to be in a small pen prior to our arrival and withhold food and water for 12 hours.

Access: You must provide easy and safe access to the animals for our shearing team. The area must be secure and safe for the animals and workers. There needs to be a outlet in the area of shearing.

Health and Safety: You are responsible for ensuring that animals are in good health. If an animal appears sick or unfit for shearing, we reserve the right to refuse service for that animal.
6. Shearing Company Responsibilities

Qualified Staff: All our shearers are experienced and trained professionals who will handle your animals with care and respect.

Safety: We are committed to providing safe and efficient shearing services. We will take all necessary precautions to minimize any harm to your animals.

Insurance: We carry liability insurance to cover accidents or injuries during shearing services to the shearers. However, we are not responsible for pre-existing injuries or health conditions of the animals. We are also not responsible for any damages to the sheep as a result of shearing or any treatments from Oakley Acres Farms.
7. Liability and Limitations

Damage to Property: Oakley Acres Farms is not responsible for any damage to property unless caused by the negligence of our workers.

Animal Injuries: While we take all necessary precautions, shearing does involve handling live animals, and there is a minor risk of injury. We are not liable for injuries resulting from the natural behavior of animals or from any pre-existing conditions. We are not liable for any damages or death as a result of shearing or any other treatment from Oakley Acres Farms.

Force Majeure: We are not responsible for failure to fulfill the shearing services due to circumstances beyond our control (e.g., severe weather, accidents, illness, or acts of God).
8. Confidentiality and Privacy
We value your privacy. Any personal or farm-related information shared with us will be kept confidential and used solely for the purpose of providing services. We will not share your details with third parties unless required by law.
9. Dispute Resolution
In the event of a dispute, we encourage an open dialogue to resolve the matter amicably. If an issue cannot be resolved through direct communication, we agree to pursue mediation or arbitration before seeking legal recourse. Any legal action will be taken in the jurisdiction of Kansas.
10. Termination of Service

Termination by Client: You may terminate the service at any time before the scheduled appointment. However, a cancellation fee will apply if you cancel within [insert time frame].

Termination by Shearing Company: We reserve the right to terminate the service agreement if the client fails to provide a safe working environment, does not fulfill payment obligations, or if the animals are deemed unfit for shearing.
11. Waiver of Liability
By engaging in services provided by Oakley Acres Farms Shearing, the client does hereby acknowledge and assumes the risk of participation in any and all activities with Karin Witthar / Oakey Acres Farms, LLC. He/she does hereby acknowledge that he/she will release Karin Witthar / Oakey Acres Farms, LLC , its officers, staff members, volunteers, advisors, property owners, and/or agents in any location where shearing activities are conducted, of and from all claims which may hereafter develop or accrue to them on account of injury, loss or damage, which may be suffered by said minor or to any property, because of any matter, thing, or condition, negligence or default whatsoever, and they hereby assume and accept the full risk and danger of any hurt, injury or damage which may occur through or by reason of any matter, thing or condition, negligence or default, or any person or persons whatsoever.
The person engaging services executes this release acknowledges that there is a valid consideration to executing this release. The invalidity of any statement or waiver of rights above under local, state, or federal law does not invalidate any other statement or waiver of rights above.
